Terms of Service & Risk Disclaimer

TradeSmart is a trade journal and tracking tool. It lets you record trades, watch prices, set targets and stop-losses, see daily summaries, use live chat, and (on paid plans) use AI features that review your own trading records. TradeSmart does not place trades or hold your money.

You must be at least 18 years old, and if you use TradeSmart for a business you must have authority to bind it.

All information in TradeSmart — including prices, alerts, blog articles, chat and AI output — is for general and educational purposes only. It is not financial, investment, legal or tax advice, and is not a recommendation to buy, sell or hold any asset. We are not licensed financial advisers. Your trading decisions are your own responsibility.

Trading shares, cryptocurrency and other financial products can result in losing some or all of your money. Past results are not a guide to future results. Never trade with money you can't afford to lose.

Keep your login details private — you are responsible for activity under your account. Please give accurate information and keep it up to date. Outputs are only as accurate as the trades and notes you enter.

You must not:

• use TradeSmart for anything unlawful, fraudulent, or to send spam;
• infringe anyone's intellectual property or post content you don't have rights to;
• upload malware, probe or attack our systems, or scrape the service;
• reverse engineer, resell or redistribute the service, or get around usage limits;
• use the AI features to create illegal, hateful, deceptive or impersonating content (including deepfakes), or try to bypass their safeguards;
• harass other users in live chat.

AI insights, signal reviews, captions and videos are generated automatically and may be wrong, incomplete or misleading. You are responsible for what you enter, for checking output before relying on it or posting it, and for having the rights to any content you upload. You may use the output you generate. We may remove or restrict content, filter outputs, and suspend accounts that misuse these features. Rights-holders can report infringing content to tradesmart208@gmail.com; repeat infringers will lose access.

Henry Wimmer owns TradeSmart, including its software, design, written content and branding. We give you a limited, non-exclusive, non-transferable right to use TradeSmart for your own use within your plan. You keep ownership of the trades and content you enter, and give us permission to store and process it only to run the service.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Paid plans are monthly subscriptions that renew automatically until cancelled. New subscribers get a 7-day free trial; if you don't cancel before it ends, you'll be charged the plan price. We don't guarantee TradeSmart will be uninterrupted or error-free. Prices, calculations, alerts and AI output may be delayed, incomplete or wrong, and third-party data sources can fail. Always check figures with your broker before acting. To the fullest extent permitted by law, we disclaim all implied warranties.

To the fullest extent permitted by law, we are not liable for trading losses, missed profits, missed alerts, lost data, or any indirect or consequential loss arising from your use of TradeSmart or reliance on its content. Our total liability is limited to the fees you paid us in the 12 months before the claim.

Nothing in these terms excludes rights you have under the Australian Consumer Law or other laws that can't lawfully be excluded, or liability for fraud, death or personal injury.

We may suspend or close your account if you seriously or repeatedly breach these terms, don't pay, or create a security or fraud risk. You can stop using TradeSmart and cancel any time. When an account is closed, we delete its data within a reasonable time, unless the law requires us to keep it.

These terms are governed by the laws of Queensland, Australia, and disputes go to its courts. We aren't responsible for delays caused by events beyond our reasonable control. We may update these terms; continued use after a change means you accept the update.
